Answer to Question 1

The legal rights that contractors have if there is a cardinal change on a construction project are to walk off of a job, claim breach of contract, and try to recover a reasonable amount for the work already completed if an owner requests excessive changes, which are referred to as cardinal changes. Normally, before this happens the owner and the contractor would agree to void the original contract and renegotiate a new contract that incorporates the desired changes, and that includes additional compensation for all of the requested changes. Another option is for the contractor to complete the job and then file a claim for the additional services, direct costs, overhead, and profit.
