Answer to Question 1

Under denial of justice, governments try to make sure that their citizens receive due process of law (access to the legal system and a fair trial) when they are involved in a lawsuit in another country. Expropriation occurs when a host nation seizes the property of a foreigner (such as construction equipment) without proper compensation. Foreign governments do not even have to seize, or transfer the title of property for a case of expropriation to arise, as they only have to prevent an owner from using their property.

The Engineers Joint Contract Documents Committee (EJCDC) Document 1910-8 provides a Work Directive Change Order form, the EJCDC Document 1910-8 includes a Field Order Change form that authorizes contractors to perform minor changes to the contract if changes will not alter the contract price or time and these do not have to be signed by the owner, the American Institute of Architects (AIA) Document A201, Construction Change Authorization form, that is also used by some engineers to authorize changes and to instruct contractors to proceed with the changed work.
