Answer to Question 1

A court system would determine whether an agent had actual authority to perform on the behalf of a principle by analyzing the circumstances of each of the particular situations where the authority of an agent is in question, it will review the normal procedures and practices of the business owned by the principles, and it will take into consideration the objective that the principle was attempting to accomplish.

Answer to Question 2

A principle needs to rely on an agent in order to be able to accomplish tasks that they may not be familiar with or that they do not have the time to manage themselves.
