Answer to Question 1

Case law contains each of the following components: facts, judicial history, issues, and rules. The key facts are provided by the court. The judicial history explains the prior proceedingsin other words, what happened in the lower court(s). Issues are the legal questions before the reviewing court. Rules are the primary law relied upon by the court in the analysis or reasoning component of the case.

Answer to Question 2

Primary sources are the resources that provide the actual law. Primary sources are found in statutes, case law, and the U.S. Constitution. Secondary sources are tools used to understand the law. One such tool is a legal encyclopedia that explains the law.
