Under his will, Arthur left 30,000 to a charitable organization called, FOREVER LOVE ANIMAL SHELTER.. Sadly, when Arthur passed away, the charity no longer existed. The following substitute charities have been proposed: 1) Goodwill, 2) Red Cross, 3) Battered Women's Shelter, and 4) Save the Animals Clinic. Which of the foregoing charities should be selected to inherit from Arthur's estate? Fully explain the legal basis for your selection.

Answer to Question 1

Save the Animals Clinic should receive the 30,000 under the Cy Pres doctrine because it is the closest charity to Arthur's original selection.

Answer to Question 2

Betty should be encouraged to meet privately for the interview without the caregiver present. Unless Betty is insistent, the caregiver should not be allowed into the consultation. The interviewer must be extremely careful that Betty is not under the undue influence of the caregiver.
