Answer to Question 1

An arraignment takes place before a defendant goes to trial. It is the judicial process whereby the defendant is informed of his or her constitutional rights, allowed to plead, and bail may be set. The sentencing proceeding takes place after a trial, specifically after a defendant has been found guilty. It is the punishment as adjudicated by the court to the defendant after trial.
