Answer to Question 1

Under EPCRA, each SERC was required to designate local emergency planning districts and appoint Local Emergency Planning Committees (LEPCs) for each district.

It is the responsibility of each SERC to supervise and coordinate the activities of each LEPC, to establish procedures for receiving and processing public requests for information collected under EPCRA, and to review local emergency response plans.

The local LEPC membership must include, at a minimum, local officials including police, fire, civil defense, public health, transportation, and environmental professionals, as well as representatives of facilities subject to the emergency planning requirements, community groups, and the media. The LEPCs must develop an emergency response plan, review it at least annually, and provide information about chemicals in the community to citizens.

Answer to Question 2

The NEPA process begins with the Environmental Assessment. A federal agency, under certain circumstances, must prepare an environmental assessment, a concise public document for which a federal agency is responsible, that serves to:

1 . Provide brief sufficient evidence and analysis for determining whether to prepare an environmental impact statement or a finding of no significant impact;
2 . Aid an agency's compliance with the Act when no environmental impact statement is necessary; and
3 . Facilitate preparation of an environmental impact statement when one is necessary.
