With a writ of certiorari, the Supreme Court orders a lower court to send it the
o record of a case for review. A party can petition the Supreme Court to issue a writ of certiorari, but whether the Court will do so is entirely within its discretion.

o The Court will not issue a writ unless at least four justices approve of it. This is
called the rule of four..
Like all appellate courts, the Supreme Court normally does not hear any evidence.
o The Court's decision in a particular case is based on the written record of the
case and the written arguments, or briefs, that the attorneys submit.
