The use of deadly force in prisons is not uncommon. The courts have ruled that deadly force is allowed in order to prevent the commission of a felony or the infliction of severe bodily harm. Deadly force must only be used as a last resort after all other means have failed. Prison officials are not liable for the use of deadly force unless it is proved that they acted in a wanton manner.

Answer to Question 2

Two critical issues involving physical abuse include inmate on inmate abuse and correctional officer on inmate abuse. The courts have ruled that prison officials are liable for damages if they display indifference to attacks on inmates occurring inside the prison. According to the courts, if force is used in a good faith effort to maintain control, there is no liability on the correctional staff. However, if the prisoners can prove that corrections officers acted maliciously, then the corrections staff can be held liable.
