Answer to Question 1

An implied-consent law states that the operator of a motor vehicle on a public highway must either consent to a test for alcohol intoxication, if requested, or lose his or her license for some designated periodusually six months to one year. Implied-consent laws were implemented to prevent drivers from refusing to take a breath test on grounds of self-incrimination.

Answer to Question 2

A per se law states that any individual meeting or exceeding a defined blood-alcohol level (usually 0.08 percent) shall be deemed intoxicated, and no other proof of alcohol impairment is necessary.
