Answer to Question 1

A vehicle inventory must follow a lawful impoundment, be of a routine nature, follow department policy, and not be used as a pretext concealing an investigative police motive. A person inventory is justified on similar grounds, except that it must be preceded by a lawful arrest.

Answer to Question 2

Vehicle inventory, which is a procedure used to take record of a vehicle's contents after it has been lawfully impounded. Vehicle inventories do not invoke the Fourth Amendment and do not require probable cause.

Person inventory, which is a procedure used to take record of a person's personal possessions after he or she has been lawfully arrested. Person inventories do not invoke the Fourth Amendment and do not require probable causebut they can only occur after a lawful arrest (that is, one satisfying Fourth Amendment requirements).
