In this situation, the contractor is claiming that a constructive change occurred and that a change order should have been issued for the work. The contractor will still perform the work but a claim will be filed for additional compensation that will be reviewed during negotiations, arbitration, or litigation depending on which dispute resolution method is used for a project.
