Answer to Question 1

These are plans required by the Civil Justice Reform Act of 1990 whereby each federal
district court is required to devise a plan to curtail the costs and shorten the time involved in
most litigation. Access to ADR is a required part of every plan. Also required is a neutral
evaluation program wherein the legal and factual basis of each case is presented to a neutral
court representative at a nonbinding conference conducted early in the litigation. The neutral
is selected by the court, and the conference must be attended by parties or party
representatives with authority to make binding decisions.
